OFFICIAL PROMOTION RULES
 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN A PRIZE. Purchasing any Sea Ray products or services, or the products or services of their respective affiliates, will not increase your chance of winning.

ELIGIBILITY: To enter the "Sea Ray Summer Photo Sweepstakes" (the "Promotion"), you must, at the time of entering, be: (a) a citizen of, or a lawful permanent resident of, the United States or Canada (excluding residents of Quebec); and (b) 18 years of age or older. Promotion is void in Quebec and where otherwise prohibited by law or otherwise restricted. Employees of Brunswick Boat Group (the "Sponsor") and its affiliated companies, parents, subsidiaries, service partners, and advertising and promotion agencies (collectively, "Promotion Entities"), and their IRS dependents, immediate families (i.e. parents, children, siblings, spouse) and members of their households (whether related or not) are ineligible to participate in this Promotion.

HOW TO ENTER: NO PURCHASE IS NECESSARY.

To enter, submit a photo on Twitter, Facebook or Instagram with the hashtag #SeaRaySummer and tagging @SeaRayBoats or by uploading a photo to https://www.searay.com/sea-ray-summer-2021 between May 28, 2021 and September 6, 2021, (the "Promotion Period").  Photos must be received during the Promotion Period. 

Entrants may submit multiple entries. 

Each entrant shall retain the copyright to the entrant’s submitted photo.  By submitting a photo to the Promotion, entrant hereby grants to Sponsor and its affiliates and advertising partners a non-exclusive, perpetual, worldwide, royalty-free license to use the Photo in connection with Sponsor’s social media and marketing and advertising of Sponsor’s products via the internet and social media platforms. 
In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the owner of the Facebook, Instagram or Twitter account associated with the entry or the authorized account holder of the email account of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to a Facebook, Instagram or Twitter account or an email address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

PHOTO ENTRY REQUIREMENTS
The purpose of this Promotion is to celebrate summer boating season.  Photos should convey the theme of summertime boating fun and feature an on-water or boating specific activity.  While this theme is general in nature, photo entries must comply with the following: (a) be uploaded in .jpg format with a maximum file size of 2 MB if uploaded via SeaRay.com/Sea-Ray-Summer-2021; (b) contain the hashtag #SeaRaySummer and tag @SeaRayBoats; (c) not contain any copyrighted or trademarked content (other than as owned by the entrant or Sponsor); (d) not show any recognizable individual other than the entrant unless the entrant has obtained permission from all living individuals appearing recognizably in the photo (or the parent/guardian of any minors appearing in the photo); (e) not contain vulgar, pornographic, obscene, reckless, illegal or indecent behavior; (f) not defame or libel any third party; or (g) invade the reasonable privacy of any third party. 

By submitting a photo, the entrant represents and warrants that he or she owns the photo submitted, or has obtained permission from the owner of the photo to enter the photo in this Promotion and entrant has obtained permission from all living individuals appearing in the photo (or the parent/guardian of any individuals appearing in the photo who are under 18 years old) to submit the photo as part of this Promotion and allow Promotion Entities the right to post the photo on the Sponsor's digital properties in accordance with these Official Rules.

Entries that do not comply with these Official Rules or that otherwise contain prohibited or inappropriate content as determined by the Sponsor, in its sole discretion, will be disqualified and will not be considered for prizes. Sponsor further reserves the right, in its sole discretion, to remove, block or restrict any entry that Sponsor believes does not comply with these rules or edit any entry to blur out third party trademarks, names or logos.

Sponsor makes the final determination as to which entries are eligible to take part in this Promotion and Sponsor's decision shall be binding.

PRIZES: 
One (1) grand prize winner will receive a vacation voucher with an approximate retail value of $4,000 to be redeemed by October 1, 2022. Voucher to be provided by World Travel.
Prizes cannot be substituted, assigned, transferred, or redeemed for cash by winner; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion.

WINNER SELECTION & NOTIFICATION: 
Sponsor will select and notify one (1) winner on or around September 13, 2021.  Sponsor will be responsible for delivering the travel voucher to the winner within approximately ten (10) business days after the winner has verified his or her mailing address.  If a winner is Canadian, the winner will be required to correctly answer a skill question consisting of a three-part mathematical question. 

If a randomly selected winner fails to respond to Sponsors’ prize notification or the winner is unable to use or is otherwise ineligible to receive a Prize, that winner will be disqualified and, at Sponsors’ discretion, an alternate winner may be selected.

CONDUCT:
Entrants who attempt to bypass software or security measures, whether directly or indirectly, will be disqualified. If any entrant believes that another entrant is cheating or attempting to cheat, such entrant should not post accusations of cheating on the Sponsor's Facebook, Instagram or Twitter page, but should instead send a message to Sponsor to [email protected].

Comments posted on the Sponsor's Facebook, Instagram or Twitter page that it deems offensive, prejudicial, violent, harassing, threatening, profane, misleading, or otherwise objectionable or contrary to the interests of Promotion Entities or other entrants will be deleted as determined in the sole discretion of the Sponsor. Sponsor reserves the right to report such instances to Facebook and block access to the Sponsor Facebook page.

CONDITIONS: 
Entrants acknowledge and understand that the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Twitter.

All federal, state or other tax liabilities (including income taxes) arising from this Promotion will be the sole responsibility of the winner. Except where prohibited by law, the winner's entry and acceptance of the prize constitutes permission for the Sponsor to use said winner's name and photograph in all forms of media, in perpetuity, without further compensation. Winning entries and prizes are not transferable; no prize substitutions are allowed except by the Sponsor who reserves the right to substitute prizes with prizes of equal or greater value. The prize cannot be redeemed for cash. The Sponsor, its affiliates and agencies are responsible for prize delivery only. Sponsor does not make any representation or warranty with respect to the prizes, and hereby disclaims any and all express and implied warranties, including warranties of merchantability and fitness for a particular purpose with respect to the prizes.

Incomplete, inappropriate, unintelligible or otherwise non-compliant entries will be disqualified. Entrants who supply negative or inappropriate photos/comments will be disqualified. Entrant must be the rightful owner of the email account used for entry. Entrants are solely responsible for internet connection and usage rates, if any, charged by your internet service provider. In the event of a dispute as to the identity of an entrant, the authorized Facebook, Instagram or Twitter account holder or owner of the email address associated with entry will be deemed to be the entrant. HIGH VOLUME OF ENTRIES OR TECHNICAL DIFFICULTIES WITH THE SYSTEM MAY RESULT IN TEMPORARY INABILITY TO ENTER THE PROMOTION SUCH THAT AN ENTRANT'S ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. SPONSOR IS NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRIES OR COMMENTS NOT BE RECEIVED DUE TO SUCH DELAYS OR TECHNICAL DIFFICULTIES.

WAIVER:
Promotion Entities, Facebook, Instagram and Twitter are not responsible for any technical, mechanical, printing, typographical, human or other error of any kind relating to or in connection with the Promotion, including, without limitation, errors which may occur in the administration of the Promotion, the processing of entries, the announcement of the prize or any Promotion-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Promotion; for incomplete, lost, late, stolen, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries; or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections or failed, incomplete, garbled or delayed computer transmission, which may limit an individual’s ability to participate. Sponsor reserves the right in its sole discretion, to disqualify any entrant or entry that is in violation of the Official Rules or to cancel, suspend or modify the Promotion and disqualify any implicated entrant(s), (and their entries) if any fraud, virus, actions by entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security or proper play of the Promotion, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to award any prize in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation or to take any other action it deems equitable to fairly award any prize.

NO LIABILITY: 
By entering, entrants and the winner agree to comply with all Official Rules as stated and agree to release, discharge, indemnify and hold harmless the Promotion Entities, Facebook, Twitter and Instagram, and each of their respective officers, directors, employees, representatives and agents from and against any claims made by the winner, entrants, or any other third parties, related in any way to the operation of this Promotion as well as any other claims, damages or liability resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Promotion.
